Admite recursul declarat de pârâtul XXXţean Timiş.
Modifică în parte sentinţa civilă recurată şi înlătură obligarea pârâtului atât de la plata drepturilor băneşti pentru perioada 1.01.-XXX, cât şi de la plata drepturilor salariale acordate prin alin. 6 din dispozitivul hotărârii.
Menţine celelalte dispoziţii ale sentinţei recurate, cu precizarea că drepturile băneşti de la alin. 5 şi 7 din dispozitiv vizează membrii de sindicat care nu le-au încasat pe state de plată şi nici nu posedă titlu executoriu.
