Admite acţiunea, astfel cum a fost completată.
Obligă pârâţii să plătească reclamanţilor XXX, XXX – Doru, XXX drepturile băneşti cuvenite cu titlu de prime de concediu pentru anii 2004,2005,2006, reclamantului XXX – Gabriel, drepturile cuvenite cu acelaşi titlu pentru anii 2004 şi 2006, iar celorlalţi reclamanţi aceleaşi drepturi pentru anul 2006, sumele urmând a fi actualizate în raport XXX coeficientul de inflaţie, începând cu data exigibilităţii lor şi până la data efectuării plăţii.
Respinge excepţia lipsei calităţii procesuale pasive a chematului în garanţie XXX, invocată de acesta.
Admite cererea de chemare în garanţie.
Obligă chematul în garanţie să vireze pârâţilor fondurile necesare pentru plata acestor drepturi băneşti.
Cu drept de recurs în termen de 15 zile de la comunicare.
Pronunţată în şedinţa publică de azi, 6 martie 2008.
